Aussie court clears Google in deceptive ad case

(AP) ? Australia's highest court on Wednesday threw out a ruling against Google Inc. that had found the Internet giant guilty of breaching trade law by hosting deceptive advertisements.

The High Court's decision overturned a federal court ruling from April that Google had engaged in misleading or deceptive conduct with four ads that appeared on its Google Australia website. The advertisers used the names of competitors as keywords to trigger their own ads appearing.

The federal court ruled this was likely to mislead people searching for information about those competitors, and therefore violated Australia's Trade Practices Act, which bars corporations from engaging in deceptive conduct. Google argued that it was not responsible for the content of the ads, and therefore couldn't be found to have violated the act.

The High Court sided with Google, stating in its ruling that the search engine is not unlike newspapers or broadcasters that publish the ads of others.

"Google did not author the sponsored links; it merely published or displayed, without adoption or endorsement, misleading representations made by advertisers," the court wrote in its judgment. It said that ordinary Internet users would have understood that the links were made by advertisers and that Google hadn't endorsed them.

Google said in a statement that it welcomed the decision. The Australian Competition and Consumer Commission, which led the case against Google, said advertisers should still ensure they don't mislead consumers.

"The ACCC took these proceedings to clarify the law relating to advertising practices in the internet age," ACCC Chairman Rod Sims said in a statement. "Specifically, we considered that providers of online content should be accountable for misleading or deceptive conduct when they have significant control over what is delivered."

Tyson on 'SVU': Convicted rapist plays the victim

By Susan Young, TODAY contributor

Michael Parmelee / NBC

Mike Tyson guest stars as Reggie Rhodes on the new episode of "Law & Order: SVU."

"Law & Order: Special Victims Unit" often teases "ripped from the headlines" plots, but it?s the show?s casting of Mike Tyson for Wednesday?s new episode -- titled "Monster's Legacy" --?that has generated headlines since news of his guest appearance broke last month. His role? Reggie Rhodes, a sympathetic victim of child abuse who murdered one of his attackers.

In real life, the former undisputed heavyweight champ was arrested in connection with the rape of an 18-year-old beauty queen, Miss Black America hopeful Desiree Washington, in July of 1991. In February of the following year, he was convicted of one count of rape and two counts of criminal deviate conduct. Tyson served three years in prison for the convictions.

News of his "SVU" part shocked fans of the show, but what better way than during the February sweeps to draw attention to your program? Stunt casting is a tried-and-true tool networks have employed to amp up the ratings.

But inviting "Iron Mike" to ?SVU? appears to be particularly scurrilous given the fact that the show has always been an advocate for victims of sexual abuse. Series star Mariska Hargitay, who plays Det. Olivia Benson, even founded Joyful Heart Foundation in 2004 to help heal, educate and empower victims of sexual abuse. (According to the Washington Post, the organization has opted to disassociate itself from the casting decision.)

Interestingly on Wednesday's episode, Benson -- always a huge advocate for the rape victims -- ?appears to work hard to get viewers to see Tyson's Rhodes as the victim:

Casting such a high-profile sex offender -- one who continues to deny his guilt --? in a sympathetic role has been more than some can stomach. That includes the more than 15,000 people who have signed a Change.org petition to reconsider the casting.

Creator/producer Dick Wolf put aside such concerns when he released a statement earlier about the episode that didn?t address the issue of hiring Tyson:

I invite you to watch Emmy Award winners Ed Asner and Andre Braugher, and Mike Tyson guest star in the ?Monster's Legacy? episode of ?Law & Order: SVU.? ?It focuses on what can happen when there is an emotionally charged rush to judgment and it is, in my opinion, one of our strongest episodes in the last five years.

Best regards,

Dick Wolf

The episode was originally scheduled for Feb. 13, the eve of the global event One Billion Rising, which supports rape and abuse survivors. "Monster's Legacy" was moved up to Feb. 6 with no explanation given. NBC denies that there is any connection.

The network is not allowing interviews at this point with any of the cast or producers. It would be nice to hear their reasoning in casting Tyson, and if it indeed went past the intention to cause controversy.

As such, we can only go by producer Warren Leight?s series of seven tweets on Jan. 12:

Even if those discussions lead to the inevitable conclusion that no matter how well intentioned a series can be, producers might still pull a few tricks out from their sleeves to jolt ratings.

"Law & Order: SVU" airs Wednesdays at 9 p.m. on NBC.

Pick Mix Serve

I?m here in Chicago today nervously gearing up for my appearance on WGN?s Lunchbreak to talk about Valentine?s Day for two (and share one of my favorite new recipes). But I just couldn?t wait to share this salad I made last weekend with you. The way it?s composed on the plate is just beautiful and tastes damn good. Most beet salads have cheese, but the way the ingredients came together on their own made the cheese unnecessary. Also, dressings that are too acidic are a challenge to pair with wine. I?m always concocting new wine-friendly salad dressings that are light on acid but still full of flavor. (Is it okay if I have a glass of wine right now?? It might help with the pre-show jitters).

?

Beet Salad with Tangerines and Marcona Almonds?

Serves 4-6 people

4 tangerines, preferably Clementines or Satsumas, segments of two and juice of two

?

Pick Notes: Our Clementine trees are full of delicious fruit right now. Clementines are sweeter than the Satsumas, but occasionally do have seeds. When you are peeling the fruit you can give a little pinch at the top of each segment and any seeds will pop to the surface.??My non-scientific study is about three segments in the whole fruit will have seeds.

?

6 medium size beets

Mache, about 4 cups

1/3 cup Marcona almonds

2 green onions, sliced thin

1/8 cup red wine vinegar

1/4 cup olive oil

1/2 tsp kosher salt

?

Boil beets in salted water for 30 minutes (some beets take longer than others to cook so to check their doneness by piercing with a knife). Peel the skin off by rubbing with a paper towel. The skins should come off very easily? beets do stain so be prepared with an apron to protect your clothes. If you?ve just had a manicure than for God?s sake wear some gloves.

?

Cut the beets in half and then segment those halves in thirds. ?We are making lots segments here, take a peek at the photo of the finished salad.

?

While your beets boil, make the dressing. ?Mix the tangerine juice with the vinegar and whisk in the oil. This is where you want to use the best quality olive oil you have. Add the salt and taste.

?

beets

?

Toss the beets in about 1/4 cup of the dressing and add some salt and pepper. Then let it sit for up to one hour tossing with a spoon from time to time. (If you have the time. If not, don?t worry about it).

?

Peel the other two tangerines into segments, the beets and the tangerines should be the same shape just different sizes.

?

Assemble the salad. Just before eating assemble the salad by tossing the Mache with the dressing. ?Adding a small amount of the dressing and toss with tongs, taste and add more if needed. ?Position the beets in three piles on the platter and fill in the negative space with greens. Next, add the tangerine slices, nestling them all around the platter. ?Finish by sprinkling over the green onions, the almonds, sea salt and ground pepper.

ASUS video showcases 7inch MeMo Pad, flaunts what the $150 tablet can do

Lately, ASUS hasn't exactly been the best at keeping some of its secrets under wraps, but the company is trying to be as good as it can be about helping potential customers better understand its devices. More specifically, it's the recently announced 7-inch MeMo Pad, with the Taiwan-based outfit taking to YouTube to release a simple and somewhat informative video on some of the tidbits you can expect out of the Jelly Bean-loaded, budget-friendly tablet. Naturally, ASUS is quick to point out how the MeMo Pad's relatively small chassis "fits perfect in your palm," as well as showing off how effortless it is to stay in the social loop with video calling capabilities and things such as BuddyBuzz. Other touted features of the 7-inch slate include its expandable storage via that microSD slot, plus the easy access to various productivity and entertainment apps like MyPainter, SuperNote Lite and ASUS Studio -- oh, and for folks who enjoy a little color, the previously seen trio of Spectrum Covers can also be spotted making a quick cameo. You can "experience" the vid yourself past the break, and feel free to let us know what has you the most excited about the Nexus 7 this particular MemoPad.

Lundin Petroleum updates its 2P reserves and ... - Energy-pedia

Lundin Petroleum has announced that as at 31 December 2012 its net proven and probable working interest reserves ('2P reserves') are 201.5 million barrels of oil equivalent (MMboe) and that the production forecast for 2013 is between 33,000 and 38,000 barrels of oil equivalent per day (boepd).

Lundin Petroleum is predominantly an oil company with 91 percent of its 2P reserves being oil(3) and 89 percent of the 2P reserves being located in OECD regions.

The 2P reserves have been positively impacted by the Bertam field, offshore peninsular Malaysia, which has been added to 2P reserves. Further increases result from Lundin Petroleum's main producing assets, the Alvheim and Volund fields offshore Norway which yet again delivered better than expected reservoir performance, as well as the Brynhild field offshore Norway which gained reserves through the addition of one extra production well and an equity increase in the field from 70 percent to 90 percent. These additions were offset by reserves reductions predominantly on the Gaupe gas/condensate field offshore Norway and producing assets in the Komi Republic in northern Russia.

Lundin Petroleum's forecast production for 2013 is between 33,000 to 38,000 boepd. The production from Norway represents approx. 74 percent of forecast 2013 production and oil represents approx. 81 percent.

The reserves are based upon a third party independent audit conducted by ERC Equipoise Limited ('ERCE'). The Proven and Probable Reserves have been calculated using 2007 Petroleum Resources Management System (SPE PRMS) Guidelines of the Society of Petroleum Engineers (SPE), World Petroleum Congress (WPC), American Association of Petroleum Geologists (AAPG) and Society of Petroleum Evaluation Engineers (SPEE) and have been reviewed for compliance with the Canadian Oil and Gas Evaluation Handbook (COGEH) and the Canadian National Instrumental 51-101 Standards of Disclosure for Oil and Gas Activities. The reserves were calculated using an oil price of USD 100 per barrel in 2013, with prices and costs escalating at 2 percent per annum.

Ashley Heppenstall, President and CEO of Lundin Petroleum, comments as follows; 'I am pleased that our Malaysian business is now contributing to our 2P reserves through the inclusion of the Bertam field. I am confident that our reserves will continue to increase particularly when the Johan Sverdrup resource is booked as reserves and hope that our continued exploration program will result in further resource additions. We have been very pleased with the continued outperformance from the Alvheim and Volund fields and we expect these two fields again to be the main production contributors during 2013. We forecast to exit 2013 with a production rate in excess of 40,000 boepd with the Brynhild field coming onstream late in 2013.'

(1) BOEs may be misleading, particularly if used in isolation. A BOE conversion ratio of 6 Mcf: 1 Bbl is based on an energy equivalency conversion method primarily applicable at the burner tip and does not represent a value equivalency at the wellhead.
(2) As per industry standards the reserve replacement ratio is defined as the ratio of reserve additions to production during the year, excluding acquisitions/sales. The reserves increase is calculated as the ratio of the 31.12.2012 reserves additions over the 31.12.2011 reserves adjusted for sales and production.
(3) Includes NGL volumes

Chris Kyle Killed At A Texas Gun Range - Business Insider

Chris Kyle was the most wanted man in Iraq a few short years ago and carried a bounty on his head--only to die today at a Dallas shooting range.

WFAA Dallas reports Kyle was at the range with a neighbor. The news is still unfolding, but apparently Kyle was shot point blank and his neighbor suffered wounds that also proved fatal.

Jessica Stanton at The Daily Caller dug this up:

The Empire Tribune in Stephenville, Texas?reports?that the suspect, Eddie Ray Routh, was?captured in the town of Lancaster around 9:00 p.m. Law enforcement officials believe Routh is a ?highly trained individual with military experience.?

Jack Murphy at the Special Operations Forces Situation Report (SOFREP) published a?post?regarding the tragic murders on Saturday night, reading in part: ?Chris had been volunteering his time to help Marine Corps veterans suffering from PTSD and mentoring them. ?Part of this process involved taking these veterans to the range where one of them snapped and killed Chris and his neighbor for reasons that remain unknown at this time. ?The perpetrator then stole Chris? vehicle in an attempt to escape but we have received word that the police have arrested him.?

During his 10-year stint as a Navy SEAL sniper, Chris Kyle was in every major battle of the Iraq war and was so effective at killing Iraqis that they called him "The Devil Of Ramadi" while placing an $80,000 bounty on his head.

Kyle spoke last year to Gary Buiso at the NY Post?about his book?"American Sniper," and offered a few details about what life was like as his sniper skills grew.

At 225 confirmed kills, his fellow SEAL Team 3 members called him "The Legend" and picked the comic book character? The Punisher?as their platoon's mascot.

His first kill was a woman about to throw a hand-grenade at a group of Marines. His most distant kill was from 2,100 yards away outside Sadr City in 2008.

He saw a man leveling a rocket launcher at an Army convoy and fired a single round from his?.338 Lapua Magnum?rifle with its?Nightforce power scope.

From that distance, Kyle had to factor in terrain, wind, elevation, vibration from the shot, and even?the Coriolis effect?where the rotation of the earth affects where the bullet arrives.

On that day each of these factors conspired together and Kyle hit the man before he attacked the convoy. ?God blew that bullet and hit him,? he told The Post.

Most recently, Kyle was the president of?Craft International, a veteran operated company offering special operations training. Like many servicemembers, he left the military to preserve his marriage.

Ed. Note: RIP Chris
