Elder Laws for the Protection of Elderly | Grupo Legal Advice

One of the most important areas of legal practice is the elder law. This area is focused on issues that concern the growing aging population. It is divided into three major categories: estate planning and administration; Medicaid, disability and other long-term care issues and; guardianship, conservatorship and commitment matters that involve fiduciary administration. Also under the category of elder law are areas such as wills; trusts; elder abuse, neglect and fraud; retirement planning; social security benefits; consumer protection; nursing homes and in-home car, advocacy of right and; discrimination among others.

It was in 1965 when the Older American Act, a law that provides protection to elderly was signed by President Lyndon Johnson. This law has created the Administration on aging which is a division under the Department of Health and Human Services. Moreover, with this law, grants are provided for different States specifically intended for research, demonstration and training projects in the field of aging. In its 1972 and 2000 Amendments, a National Nutrition Program for the elderly and the National Family Caregiver Support Program were added respectively. The latter was focused on helping hundreds of thousands of family members who encounter difficulties in caring for their ill or disabled elder loved ones.

It is not just the legal professionals who are responsible for stopping the abuse of elderly, even normal citizens should be aware of these issues and they have to act on it. Through education and seminars, information dissemination about elderly abuse and proper care of the elderly can raise the awareness of people and alert the authorities about these exploitations. With these efforts, it is hoped that there will be a decrease in the number of abused elderly and more programs will be initiated to protect the aging group.
